Mr. Floyd James Fernandez
Immigration Service That Cares
Floyd J Fernandez is founder and managing attorney of Pacifica Legal Services. His breadth of experience in this field has included individual visa applications, family-based and employer-based, non-immigrant work, travel, and study visas (both domestic adjustment of status and consular applications), deportation defense and appellate work (before BIA, AAO, U.S. 9th & 7th Circuits, and U.S. Supreme Court). My clientele has included individuals both from within all of Southern California, several other U.S. states, and several additional nations.

Rates, Retainers and Additional Information
A consultation with an immigration attorney can cost up to $400.00. I have both charged consultation fees of $75 - $100 and offered free consultations but have found that the majority of those seeking free consultations were there for free information and not to seriously pursue a strategy to improve or change their immigration status which became a drain on my time and unfair to the time commitment that clients who have already engaged my services deserved. Immigration law can be complex and not a "one size fits all" solution through the submittal of a single form or forms. In these consultations, a lawyer is dedicating his time and expertise to proper case analysis and strategy and should not be compared on the level of a 5 minute consultation with an immigration document preparation service or notario. Therefore, I charge a base rate of 50.00 per consultation and am willing to credit the consultation fee to a prospective client once a written agreement is entered into.

- Q. My case is in 9th circuit and my lawer is retired what should i do
- A: You need to get a new lawyer, and have him request the Court for an extension of time before the time period for filing a petition for review or, if already filed, the time period for filing a brief (a long document arguing your case), has expired.
- Q. I am a citizen and my husband is from mexico hes been here since 2007 can I ask for a petition for him ?
- A: Unfortunately yes. With your husband having lived in the U.S. illegally for more than a year when he left to tend to seriously ill family in Mexico for 7 months, he violated Section 212(a)(9)(C)(i), which means that he has a permanent bar from being able to even ask permission to obtain a waiver of his inadmissible status, unless he waits 10 years outside the U.S. He does, however, have the option of asking for an extraordinary relief from USCIS called, 'nunc pro tunc' relief, where you waive the effect of the act of his recrossing the border, based on a severe hardship on your part.
- Q. Is a class E felony for a DUI deportable
- A: Yes, if your DUI, upgraded by either the seriousness of the offense, or by an enhancement due to your committing the offense before, does leave you deportable as having committed an felony involving alcohol or controlled substance, and for a CIMT (crime involving moral turpitude.
