- Q. Is it possible to remove an old driving ticket from your record?
- A: It is possible to get some types of tickets removed from your record. The legal process in New Mexico is called a petition for expungement. The statute is Section 29-3A-4 and 29-3A-5. Check out NMOneSource (nmonesource.com). It's a really great free resource with all of New Mexico's laws and court rules.
Some types of tickets are able to be expunged, and some are not. The statutes are complex and have all sorts of exceptions and waiting periods. The petition has to include a background check, and there will be a hearing in front of a district court judge. I would suggest talking to an attorney who can help you navigate the legal process.
