Q. How can I get a new lawyer to get my husband a bond set with proof of why he missed court.
A: You have the right to retain a new attorney to replace your present one and that Attorney will be able to file a notice of appearance for your husband and a motion to set bond. It is possible that your husband will still have to remain in jail until the September 1 court date but at least the motion can get filed.
Q. If im on probation and get a misdemeanor vandalism warrant when i turn myself in will I be able to bond out before vop
A: It all depends on the agency with whom you are on probation. If they check the arrest records regularly and act quickly, the VOP may issue before you get to bond out. The commissioner or magistrate could check your record when making your bond and see you are actively on probation and notify the PO and raise your bond. There is no way to answer your question easily. Best bet is to hire an attorney and have the attorney get a deal in place with your PO for you to turn yourself in on the Vandalism and the VOP warrant so you are not throwing bad money after good.
Q. I failed a drug test while on misdemeanor probation. I left state it’s been 6 yrs what’s the limit of statutes?
A: In most jurisdictions you would probably have an additional VOP warrant out for your arrest but only within the state of TN and the SOL for the misdemeanor is 1 year. If you have been gone 6 years the SOL has probably passed but I imagine they have not purged your warrant so if you are driving through the state and get pulled over you could go to jail for an active warrant. You will still need to answer for it and get the active warrants taken care of in a very simple process. You should hire an attorney in that jurisdiction to gather all the necessary paperwork so you can turn yourself in, get processed and then get a court date and get the warrants dismissed.
