- Q. Can my employer contact my personal doctor over a personal injury requesting for a note to be changed
- A: You have a right to privacy. However, often unrepresented people sign medical authorizations or waivers that specifically allow this type of contact without really understanding what they are agreeing to. You can insist that your employer and it's representatives have no communication with your doctor other than through formal subpoenas if that's what you want. That being said, you still need to be sending the employer copies of your medical records if you hope to continue receiving benefits. If you're not represented by an attorney, you really should be.
- Q. If fired while on workers comp, can your lawyer fight to get your job back if it was an wrongful termination?
- A: Getting your job back isn't normally something that a workers comp lawyer can fight for, because it isn't something that can be awarded at trial. However, in negotiation, you can always ask. You need to have been released back to work by your doctor before you can ask to have your job reinstated. Your post isn't clear regarding your current work-restrictions per your doctor.
As far a attorney - client communications go, there is no hard rule hard rule as to how often contacts should occur. Twice a year does seem like not enough.
- Q. If a vehicle is standing that got hit by another car can I sue the driver of the standing vehicle also
- A: Liability is on the party that caused the accident, not the car that hit you. Although you CAN file suit against the driver of every car involved, you should first ask yourself, what is your good-faith basis for claiming that car was negligent.
