- Q. My son was given the wrong medicine at school.
- A: Let me start off by saying, "mistakes happen". And when there is no damage it is best to take the high road. The nurse is not perfect, none of us are. So ask yourself, who would you report it to, and what action might they be able to take? Then ask, why? The nurse has been a nurse for 25 years with only two errors. You have already spoken to the principal. In my mind, and I have been a lawyer for 44 years and I have sued over 1,000 times, but this is not a situation where I would recommend you do anything else.
- Q. My daughter hit a pedestrian and got a speeding ticket a week later. Can they use the speeding ticket against her?
- A: Only if she pleads guilty to the charge of speeding. If she does not testify, and she should not, a finding of guilt cannot be used against her in the civil case. So do not plead guilty. If the officer does not show up for the criminal trial, move to dismiss.
- Q. I wasn't told about side effects of being on methadone before I got on it or what would happen after I came off of it
- A: Let me see if I understand the situation. You were addicted to some drug or drugs and the medical doctors prescribed methadone to assist with withdrawal. Do I have that right?
Let's assume I do.
So, you're addicted to some drug and in treatment. How am I going to prove the case using you as a witness? You were an addict. Addiction clouds the mind, addiction alters the memory and basically makes the addict an unreliable witness. You won't be able to recall exactly what you were told and probably no longer have the handouts you received from the doctor's office. Where is our evidence? Who are the witnesses we can rely on to put together a case?
