Q. Is non renewal of auto insurance like this allowed in California?
A: In order to answer the question, it requires more information such as if there was a broker/agent involved as well, the policy language, any autopay agreements, etc. However, I will say that an insurance company is obligated to provide notice of cancellation due to non-payment of premium, pursuant to the California Insurance code. Their failure to provide such notice may possibly void any alleged policy cancellation by the insurance company.

A: An insurance company that fails to thoroughly investigate a claim on behalf of its insured may be acting in bad faith. If you sustained damages as a result of your insurance company's failure to thoroughly investigate a claim on your behalf, you may have a case against them. However, all the facts and details must be reviewed by a lawyer to make such a determination.

A: Generally, the negligent person that caused the accident should be responsible to pay for the damages/injuries. However, it depends on the detailed facts of each case, which is not present here. If you are taken to court and are somehow found to be negligent, even partially, then you would be responsible to pay for a portion or all of the damages/injuries. If you had insurance at the time, you can consider submitting a claim with them if it has not already been done. If there are no coverage issues, your insurance company should defend you and/or pay the claim on your behalf.
