- Q. Does NC require a separation agreement be filed prior to one year separation and filing of divorce papers if uncontested
- A: A Separation Agreement is not required to file for absolute divorce in North Carolina. The only requirement for a resident of North Carolina to file for absolute divorce is one year's separation.
- Q. How much does it cost to file divorce in New Bern
- A: Following the court cost increases of July and August of this year, the filing fee for absolute divorce in North Carolina (which includes court costs) is currently $225, with an additional $10 if a name change is involved. If process is to be served by the Sheriff, the fee for service is an additional $30. Any further pleading that contains a motion will cost an additional $20 to file.
