Gerrard McGeachy

Gerry has a track record of winning cases, even where the standard of proof is “beyond a reasonable doubt.”

Gerry has extensive experience dealing with high stakes investigations and litigation. He was called to the bar in 2000 and the Law Society of Ontario recognizes him as a Certified Specialist in Criminal Law. He has argued and won cases at all levels of court in Ontario and before a variety of administrative tribunals.

He started as a prosecutor over 20 years ago representing the province of Ontario in provincial offences matters.  Since then he has been involved in thousands of "DUI" (and related) cases including:

"Over 80";
Impaired Driving;
Impaired Care or Control;
Fail to Remain (at the scene of a collision);
Driving while Prohibited;
Impaired driving causing bodily harm.
Many of these cases involved expert toxicological evidence.  Gerry has all aspects of cases involving Charter challenges to legislation and Charter applications in which remedies were sought including:

exclusion of evidence;
stay of proceedings; and
costs;
summary conviction appeals to the Ontario Superior Court of Justice.

As a prosecutor he was lead trial lawyer on cases of all sorts including "drinking and driving" but also including the full range of criminal cases, ranging from property crime to murder, proceeds of crime, fraud and conspiracy.  He brings a wealth of trial and appellate experience to his practice. 

 During his time as Crown Counsel, Gerry received specialized training in search and seizure law, becoming  a designated Wiretap Agent for the purpose of Part VI of the Criminal Code from 2015 until his departure from the Ministry of the Attorney General in 2018.  Over the years he has addressed a wide variety of search warrant issues such as Charter applications to exclude evidence.
