- Citibank, N.A. In re ATM Fee Antitrust Litigation Representing Citibank, N.A. in a series of federal antitrust class actions. Plaintiffs allege that Citibank, along with a number of other major banks and financial institutions, illegally fixed the price of ATM interchange fees on the STAR ATM network, and seek to recover treble damages on behalf of a nationwide class of ATM users. The U.S. District Court for the Northern District of California recently granted partial summary judgment of plaintiffs' per se antitrust claims against Citibank and other defendants. The Court stated it would certify its decision for appeal to the Ninth Circuit if plaintiffs so request.

- Toyobo Incorporated Zeppetella v. Second Chance Body Armor, Inc. GIN034151 (Cal. Super. Ct. (San Diego)) Defended Toyobo in products lawsuit in connection with high-performance fiber Zylon used to manufacture bullet resistent vests. Won dismissal of the punitive damages, negligence and breach of warranty claims, and obtained a hung jury on the product defect claim. On the failure to warn claim, limited Toyobo’s liability to only 10% of damages awarded. Subsequently settled on extremely favorable terms before entry of judgment.

- Numanco LLC Waters, et al. v. Numanco LLC, et al. Defense of an asbestos products liability and personal injury action alleging that Numanco, a manpower services company, supplied workers to power plants that may have disturbed asbestos causing plaintiffs to be exposed and suffer injuries.

- Genesis Health Ventures Inc. (now reorganized as NeighborCare Inc.) Genesis Health Ventures, Inc. Weil Gotshal led the joint defense group in a $200 million lawsuit against the reorganized debtor and several financial institutions, alleging defendants engaged in fraud, conspiracy and gross negligence in connection with valuations performed with respect to the Plan of Reorganization. The bankruptcy court dismissed the plaintiffs' complaint in its entirety, with prejudice, as time-barred, and on the grounds of res judicata and collateral estoppel. more

- Sergio Suarez Martinez Crawford v. Suarez Martinez WGM filed an amicus curiae brief in the U.S. Supreme Court on behalf of a number of major refugee resettlement and advocacy organizations, including the International Rescue Committee and Immigrant and Refugee Services of America. in the case, Crawford v. Suarez Martinez (No. 03-878). The case examines the statutory and constitutional limits on the federal government’s ability to detain aliens (that is, non-US citizens) who have not been admitted as permanent residents and who are subject to an order of removal under the immigration laws requiring them to leave the country. The amicus brief argued that indefinite detention was inconsistent with various international treaties governing treatment of refugees, as well as principles of customary international law, and that the applicable US statute should be interpreted consistently with these international law doctrines.
