Mr Irwin did an Excellent job of winning my case Mr Emmett Erwin took my case .Even though I was denied twice. Mr Irwin never gave up and won the third time around.Mr Irwin an his associate Robin Johnson did an Excellent job. They both kept me very well informed through out the case. Biography

Emmett B. Irwin obtained his Juris Doctor at the University of Baltimore School of Law and was subsequently granted admittance to the Maryland Bar. Since then, he has worked to get seniors, the injured and disabled persons the benefits that they deserve. Early in his career, Emmett did Medicaid and Social Security Disability applications and appeals for patients of Johns Hopkins Health Systems, the University of Maryland Medical Systems and LifeBridge Health, among many others. In 2016, Emmett began offering services to private clients through The Law Office of Emmett B. Irwin, P.C..

Emmett also serves as Vice Chair of the Elder Law and Disability Rights Section Council of the Maryland State Bar Association, Co-Chair of the Disability Section of the Maryland Association for Justice, and is a member of the Peer Review Committee of the Attorney Grievance Commission of Maryland.

Q. I want to separate from my husband, or divorce but I'm also trying for ssdi. I don't know if it will effect income.
A: SSDI generally does not have income or asset limits, so it generally doesn't matter whether you're married, separated or divorced. But you have to have been working and paid payroll taxes for 5 out of the last 10 years before you became disabled to technically qualify for SSDI.
Q. Do adult dependents qualify for parent's social security when the parent retires?
A: Possibly, but I am only aware of Disabled Adult Child (DAC) benefits - if the adult dependent has been disabled since prior to age 22, then the adult dependent can get SSA benefits from the parent's work record. But only if the parent is deceased, disabled, or is collecting SSA retirement benefits.
Q. Does collecting unemployment affect the amount you currently receive from social security disability.
A: Generally when you apply for unemployment, you are stating that you are ready, willing and able to work full-time. You are getting SSDI because you told SSA that you can't work full-time. So there could be a problem there. However, the CARES Act temporarily changed the requirements for Unemployment, so there are much more complicated rules for unemployment applications. This is an area where it would benefit you to contact a lawyer that specializes in Employment Law.
