Diego J. Peña

Diego J. Peña currently serves as a full-time arbitrator and mediator. He began his practice in San Antonio, Texas as a commercial and business litigator. As an attorney for more than 36 years, Mr. Peña has represented individuals, small to medium businesses and Fortune 500 corporations in state and federal courts. He has litigated cases involving consumer disputes, contracts, personal injury, wrongful death, insurance claims and disputes, federal and state constitutional law claims, civil rights, labor & employment claims, religious discrimination, sexual harassment and hostile work environment, real estate disputes, oil and gas disputes, environmental issues and banking matters. He has tried more than 50 cases to verdict/judgment and has argued or appeared in more than 20 appellate cases before state and federal appellate courts, including the U.S. Fifth Circuit Court of Appeals and the United States Supreme Court.
In 1989, Mr. Peña joined the Southwestern Bell Telephone Company Legal Department. For more than 29 years, Mr. Peña personally tried more than 85 highly specialized labor arbitrations ranging from contract interpretation and special interest grievances to just cause suspensions or dismissals.
He currently serves as an arbitrator on the American Arbitration Association Employment Panel and as a public arbitrator for FINRA

Rates, Retainers and Additional Information
1. The fee for each day of hearing is $1,250. The fee for study time and writing the opinion is $1,250 per day. Study time and writing the opinion is billed in half-day increments. One half-day is 3.5 hours. 2. A cancellation/postponement fee of $1,250 per day will be charged for all scheduled hearing days if the hearing is canceled or postponed within 30 calendar days prior to the day of the hearing. (The day of the hearing is not counted.) 3. There is no travel charge for hearings that take place in the Dallas/Fort Worth area (Dallas, Tarrant, Denton and Collin Counties). If travel expenses are incurred such expenses will be charged split among the parties based on prior arrangement. Travel expenses will be charged from the Arbitrator’s Fort Worth office address. 4. If the hearing is cancelled or postponed, the parties are responsible for fees charged by a hotel for a cancellation beyond the deadline. 5.Willing to conduct pro bono arbitration or mediation on a case by case.
