Q. My mother passed we got a wrongful death suit my step father was made HOE and did not follow through on all terms.

A: In a Georgia Wrongful Death case, the surviving children have the right to share the recovery with the surviving spouse. However, under Georgia law, the surviving spouse cannot receive less than one-third of the wrongful death damages (with limited exceptions). In the scenario you have described (a surviving spouse and two surviving children) each family member should receive one third of the recovery (with limited exceptions).

The surviving spouse has a duty to act as a representative for the surviving children in bringing the wrongful death claim. After settlement and recovery of funds, the attorney for the surviving spouse should hold the funds in trust and make sure they are divided to the surviving family members according to Georgia law.

You may have a claim if the attorney has improperly distributed the funds or the surviving spouse has refused to distribute them to you after the settlement and recovery are completed. Q. I was arrested for a crime and got my court date a few days ago court papers have different charges. Why?

A: Regarding the charges themselves, a District Attorney has the right to dismiss, modify, or upgrade charges based upon his/her evaluation of the case. Bottom line, they do not have to do what the police arrest you for.

Felony charges have the potential for serious prison time, so it is really important for you to get an attorney as soon as possible. If you cannot afford an attorney, the State of Georgia must provide one to your at no cost in a criminal case. Contact the Public Defender's office in your jurisdiction and fill out an application for representation.

Q. Do lawyers accept anti-SLAPP cases on contingency?

A: It would be very uncommon to see a contingency fee on an anti-SLAPP lawsuit because their is no guarantee of payment even if the case is successful. Frequently, even in a SLAPP suit, the parties will reach alternative settlement arrangements that do not result in the case going to Court. Even though the case appears to be a SLAPP suit to the Defendant, the lawyer might actually recommend settlement. Even if a case does go to Court and resolve in the Defendant's favor, the Court may still have some discretion to award attorney fees.

SLAPP suits can be incredibly stressful for the individual being sued for this very reason. They have to pay for a lawyer out of pocket to prevent another person (usually a larger wealthier company) from taking advantage of their financial weakness. Seek out an aggressive, well-rounded civil litigator who is prepared to defeat the suit and recover fees.

Many well-rounded civil litigators will work as Plaintiff or Defense counsel depending upon the type of case involved. Sometimes alternative fee agreements can be reached, such as flat fees, or reduced fees until a case goes to trial. ... Read More
