Ethical, Committed, Kind. Evan represented me in my child custody case, which up until I met him, had been mishandled for years. He came in and with care and confidence began to 'right the ship' of my case. Over time, we won despite the fact that nearly everything was stacked against us. He provided sound legal advice, was very strong and had endurance when it was required. He is smart and personable and explained everything along the way. He is a wonderful writer of legal motions, a confident speaker, an excellent researcher of the law, and is very detail-oriented. I highly recommend Evan Woodward as a divorce attorney. Evan is very knowledgeable and experienced with New Mexico law and has a wealth of resources to draw on if needed. He was very courteous & professional, responsive, was a quick study, and was a pleasure to work with during one of the most difficult times in my life. Additionally, most of our correspondence & interaction was over the phone and via email. My initial consultation was a video chat in which we connected immediately. I also had one opportunity to meet with Evan in person, my preferred method of communication, and given that most of our time together was virtual, he was still highly effective and easy to work with. Furthermore, Evan was the second attorney in my divorce. My first attorney only wanted “easy cases” and did not prepare me for what to expect given my 37-year marriage and being the primary breadwinner. Conversely, Evan immediately gave me New Mexico marriage dissolution law and all the case precedents that judges reference during their deliberation and verdict. I may not have liked it or agreed with it, but he prepared me for the inevitable outcome of a lopsided settlement and also that neither party would be happy with the result.

Q. My mother passed away last year and I am the successor in interest to the estate but I also have 1 brother.
A: I am sorry that you lost your mother.

The answer to your question depends on the fact scenario involving your mother's Estate at the time of her passing. If your mother died with a valid will - the provisions of the will must be followed. Therefore, whomever inherited the damaged property would be entitled to those insurance benefits/payouts as well as the property itself.

However, if your mother died intestate (without a will) then it becomes a bit more tricky to answer. If your mother was unmarried at the time of her death and died intestate, you and your brother (along with any other siblings) would inherit her Estate equally. NMSA 1978, § 45-2-13. Therefore, you would share in the insurance benefits equally and/or have the option to use them to fix up the property, sell it and split the proceeds evenly.

However, if she was legally married at the time of her death (to your father or anyone else) her spouse at the time of her death is entitled to one quarter of her intestate Estate under NMSA 1978, § 45-2-102(A)(2). Further, they would be entitled to one half of the community property in the marriage. NMSA 1978, § 45-2-102(B). I hope this answers your question and/or gets you headed in the right direction.
