A: Land and anything permanently attached to the land is transferred by deed. However, if there is a mortgage on the property, transferring it will be a violation of the terms of the loan (Deed of Trust), so mom may have to refinance to get the property transferred. In addition, Mom may incur income tax liability if son tries to merely "give" her the property.

As for personal property, most things can be transferred with a bill of sale. Property which has a title document (such as a car or mobile home) must be transferred by completing the documentation on the back of the title document, and paying the taxes (which are based on the value of the property). This could also result in income tax liability to mom.

Q. A wife was awarded the prop after the divorce from her husband. She never changed deed. She did a ToDD. What happens to
A: The person who acquired the property from your wife by a transfer on death deed now owns whatever part of the property your wife owned, subject to any liens that may exist (such as mortgages or unpaid taxes). If your wife got 100% of the property in the divorce, and didn't transfer any of it before her death, then 100% of the property transfers to the grantee on the deed.
Q. What can I file saying that my neighbor agrees to let me put a business sign on their property?
A: A signage easement would certainly work, but you could also do a lease for the area you need to place your sign, or even just get written permission to place the sign on your neighbors property.
