Q. Using a person's name in a screenplay without asking for permission?
A: How were the answers you got lost time? You always have to be careful using a persons name, image, or likeness without their consent. Many states have "right of publicity laws" (for example, California where I practice). There are some exceptions to the rule (in California I am speaking about), such as: 1. Statute of limitations 2. First amendment (privilege for matters in the public interest) 3. Waiver 4. Parody 5. Copyright pre-emotion 6. Incidential use (see Aliso v. Time Life books) But before you just "flip a coin" and take your chances (it's always best to seek permission from the person), its always good to discuss all the facts of your case with entertainment counsel. I know its redundant, but if you want an answer you can rely on, you need to pony up and get the advice. best of luck!!
Q. Can I use the cowgirl photos of this game without copyright infringement
A: I am not exactly sure what your question is, but are you referring to using the Dallas Cowboy Cheerleaders for commercial products? If that is the question, I would be very careful, you can run into potential problems including with "right of publicity" claims from the individual cheerleaders and potential trademark issues with the Dallas Cowboys depending on what in particular you are wanting to do. Q. I am writing a parody of Elsa and Anna I have a disclaimer stating it is a parody
A: Parody protection can always be a tricky thing. A true parody is a work that makes fun (or "pokes fun") of the original. If you are doing that, you are in a much better position as section 107 does allow fair use protection for things like this, and for things such as "comment and criticism." It is important, however, to ask make sure you know the difference between parody (which is NOT copyright infringement) and using another's work for "satire" purposes (i.e. using Elsa and Anna to make fun of something else). In these types of cases, the courts will apply the four factor "fair use" test. You can google to find out more about that. If you plan on making a substantial investment, you might want to seek a fair use opinion letter, can be worth it to make sure you are protected in advance. Good luck. Attorney Steve®
