Q. Is it legal for my landlord to give me a 5 day notice the same day she filed with the court
A: No. The principle is that first LL will serve a notice on tenant for eviction of property. Failing thereby LL will file a suit for eviction of tenant relying on certain cause of action, which court will adjudicate in favour or against the LL.
Q. I have an early termination clause in my apartment lease that I would like clarified.
A: Conditions of lease termination are beyond any universal contractual norms rather an attempt to discourage a tenant for seeking termination. It seemed to be a one-sided clause that should not be acceptable by any tenant. It means a tenant has no choice except to pay rent for 30 days' notice period plus two months additional rent prior to move out. If a LL wants to terminate lease contract would s/he pay double the rental compensation prior to tenant move out?? You are advised to discuss it with Attorney of your local jurisdiction for specific advice. If such a terms are in vogue then it must be quashed forthwith.
Q. Can I file a claim on behalf of a co-worker, or does it have to come from her?
A: Claim has to be filed by a victim herself provided she has no disability. If you are well aware of her situation then be a witness in her claim in order to verify her claim(s).
Q. my landlord stole the car she sold us and is now evicting us what should we do
A: You may register a theft case against her and seek police assistance to recover your car. Secondly, seek assistance of Attorney of your local jurisdiction to get restraining order against any forcible eviction, replacement of locks, or denial of entry into the premises, etc.
Q. The landlord had a maintenance company enter the premises to clean out 2 bedrooms since those 2 roommates where vacatin
A: As indicated, your belongings were removed accidentally as admitted by them. If your loss is being compensated as a good will gesture then you may discuss and push for full damages as per current value and accept flexibly what they are ready to pay.
Q. Does anyone do pro bono cases regarding civil service rules?
A: Better consult and approach NY Bar where there are many pro bono lawyers who may help you out.
Q. I feel like I am being harassed by my employer. My name is being slandered due to false accusations. What can i do?
A: It does happen in case of co-workers enmities or biases that it come up in a defamatory remarks, rumors or accusations spread indiscriminately. I may advice you to take this matter up seriously with your HR through a formal letter citing certain examples or events only and ask for a thorough investigations into it in order to clear your name and unearth the very lobby that is working against your interest. Secondly, ask your HR to share their findings/reports that they prepared after your interview over the last two years. If you know who those are, keep their names secret and be vigilant of their inimical move.
Q. Can I file a counter suit against the state for a case that judgment reversed after I have served all the sentence
A: You may file against wrongful imprisonment and for damages thereon through Attorney of your local jurisdiction.
Q. How to know whether the employment bond is one sided or two sided? How to broke a bond without any legal complications?
A: It all depends on the terms of bond that you signed. Signing of a bond/contract means that you fully agree to the given terms of bond. There would be a clause as to how, who, when and on what grounds this bond can be terminated.
