- Q. I have a personal injury lawsuit in. I asked my attorney for a $500 front money on my case to pay some bills.
- A: As attorneys, we have very strict requirements on "fronting" or "advancing" client settlement funds. For an attorney, it is always concerning - Is the Client going to keep asking? What if I don't get recovery in their case? Is this a "Loan"? Most lawyers generally shy away from advancing settlements unless there is some 'known' recovery for the client (a settlement that hasn't yet been paid), the advancement is a nominal amount, and there are assurances/written understandings of payback.
- Q. When a person passes away from Asbestos, is there any way to find out whom they made there beneficiary?
- A: HI - while your question is a bit vague, I will answer the best I can. If someone dies from asbestos (mesothelioma/lung cancer/asbestos), those who have a statutory right to file a Wrongful Death claim/case are heirs (typically surviving spouse and/or children). Someone who dies from Asbestos Disease cannot prevent a Statutory Heir from filing a Wrongful Death case. If you are a direct heir of someone who died from asbestos, please call my office. With regards to "Beneficiary" status of Decedent? That relates to Estate/Probate documents. - Q. CA. Accident almost 2 years ago. Claim # for injury started. Does this need settled by 2 year if claim w/ insur started
- A: Hi - if there is any concern about the Statute of Limitation running and you are negotiating, request a 'tolling agreement'. A Tolling Agreement between you and the defendant/insurance company (I'm assuming you have not yet filed a case) will ensure the Statute of Limitations doesn't run.
