: Current; First BanCorp In re First BanCorp Derivative Litigation Defended First BanCorp and several of its officers and directors in a shareholder derivative action in Puerto Rico federal district court, involving claims for breach of fiduciary duty, abuse of control and waste of corporate assets arising from the alleged improper accounting classification of mortgage transactions and financial derivatives. Secured dismissal of the complaint.

: Current; Enron Power Marketing Inc. Enron Power Marketing, Inc. (EPMI) Obtained a significant victory in favor of the Enron bankruptcy estate involving a constitutional challenge to Congressional legislation aimed at stripping the Bankruptcy Court of jurisdiction over disputes concerning Enron's power contracts with various trading counterparties.

: Current; Canadian Imperial Bank of Commerce In re Mutual Funds Investment Litigation Defended Canadian Imperial Bank of Commerce (CIBC) in six securities fraud class actions and three shareholder derivative actions involving allegations of market timing and late trading of mutual funds. Secured dismissal with prejudice of all nine actions. Also represented CIBC in related SEC and New York Attorney General investigations of market timing practices. more
