- Q. I was charged 3/16/2016 a DWI and a refusal to submit to a chemical test. I went to court October 24 of 2016.
- A: Good evening:
A conviction for DWI in Minnesota essentially stays on a record for life, unless it is sealed through expungement. Also important to note is that although it happens from time to time, judges tend to shy away from expunging DWI cases and DWI convictions do not qualify for automatic expungement pursuant to the recently enacted MN Clean Slate Act.
- Q. In Minnesota if someone comes breaks into you home can you just shoot them and receive no punishment?
- A: Minnesota has a version of the castle doctrine. Under State law a person has no duty to retreat from their own home and is allowed to use deadly force, including shooting an intruder, to prevent a felony from occurring within the home.
- Q. In mn if a man is arrested for dv but the victim doesnt show will charges be dropped
- A: It really depends. If the alleged victim was served a subpoena to be at court for the trial, some prosecutors will actually ask for a warrant to be issued for the alleged victim.
