I hired this man, then after a few months, I fired him and had to start the process all over with another attorney. I had spent a small fortune with him, before realizing that he was just looking for ways to charge me and not get me any results. I had
to cut my losses and start over, I hope you dont make the same mistakes I did. When your family is at stake, and your getting charged $300 an hour, you want that attorney to give you his best; anything less is just unacceptable.
Here is the thing about the legal con, they only get paid for the work they do, not for winning. If they want to get paid the most, they needlessly file lots of papers, go to lots of meetings with the colleagues (you get charged for those meetings), have thier paralegals charge you $200 to answer an email, etc. Thats how they make their money. The more complicated and drawn out they can make your case, the more money they get from you. No where in this equation do you win your case, once you win, you stop paying!
Thats if you are even able to win. What if you had a losing case from the beginning? Would they tell you? They didnt with me. I wound up finding out they didnt think I could win when their paralegal, who didnt know the details of my case, explained that the only way I could win was if a number of things could be proven. I wasnt even claiming those things had happened, and I was basically fighting a losing battle, and paying out the nose to do so. Had he told me the honest truth then I doubt I would have paid him so much, false hope is expensive.
He is a liar, he charged me more than five grand to file a motion with the court. He never filed it! There was no record in the court of those papers being filed. My new attorney discovered this, I assumed they were filed like Mr. Niedens had said they were.
Aside from con he is pulling, he is also bad in court. During the first hearing, he kept repeating the same questions over and over, even though they weren't relevant to my case. He did not seem to be aware of the evidence I gave him, and did not even submit it to the court so it could be discussed. I had evidence of wrongdoing, that he simply did not read through and understand. He made me think that a lot of the evidence I provided could not be entered into the court record. I found out from my new attorney that it can be entered in. I hope with the new case that I am being forced to file that this valuable evidence will be seen by a judge. Mr. Niedens really failed me here.
Getting in touch with Mr. Niedens is a test in patience. Typically it is his paralegal that gets back to me, usually taking two to three weeks to get a response. I guess Mr. Niedens is either overworked or fond of his personal time. Either way, I came to understand that my case was of little importance.
This man sounds confident, says the right things, looks good in a suit, etc. Dont let that fool you, judge him by his actions.
