- Q. I was arrested for a DUI but I wasn’t in the vehicle.
- A: The State can attempt to establish that you were operating the vehicle while impaired, or with an unlawful blood alcohol level, by circumstantial evidence. It might be a tougher case to prove, but it can be done. We don't know any of the facts of your case from your question, so it's impossible to offer a well-reasoned opinion. Discuss this with an attorney.
- Q. Marion County Florida was arrested for dwls and wrong tag on my car do sheriff's depth have the right to search my car
- A: An inventory search of your car incident to an arrest is permissible without a warrant or your permission.
- Q. Can you be arrested for driving with suspended license on private property, not in a vehicle, and plate not called in.
- A: Law enforcement officers have the right to enforce traffic laws anywhere the public has a right to travel- even private property in most cases. Shopping mall parking lots are privately owned, but the public can navigate them. The next issue becomes if you were in or out of the vehicle or the officer had probable cause to believe you were or had been.
