Legal Answers
13 Questions Answered
- Q. In California how far back does a live screen background check go?
- A: Live scan will go as far back as when you turned 18. You should have it expunged.
- Q. Is an IID required despite it not being court ordered and wasn't mentioned until trying to reinstate driver's license?
- A: If he had a prior DUI within 10 years of this latest DUI, then IID is required, regardless of what the court ordered. Court will not discuss this with him. This is up to his lawyer (if he had one) to advise him on.
- Q. Blood vial used for dui
- A: If there are no preservatives, then the alcohol content will multiply over time. So the BAC in the report won't match the BAC of a re-test. Remember you have the right to have the blood re-tested by your own expert. You will want to hire a lawyer for that.
