Jason Neufeld is the founder of Elder Needs Law, PLLC, and is proud to represent senior citizens and younger disabled adults in various matters including Medicaid Planning, Estate Planning, Incapacity Planning and Probates throughout Florida.
Since 2012, Jason has been honored as a "Super Lawyer" by Super Lawyer's magazine or a "Legal Elite" from Florida Trends magazine. Jason earned his Bachelors of Arts degree from Emory University and obtained his Juris Doctorate and Masters of Business Administration (JD / MBA) degrees from the University of Miami.
Jason is on the board of directors of the Academy of Florida Elder Law Attorneys, North Dade Bar Association, North Miami Beach Chamber of Commerce and the Broward Coalition on Aging. He is also a member of the National Academy of Elder Law Attorneys and a Leadership Broward Class XXXII (Aroo!) Graduate. Jason sits on the Miami-Dade Mayor's Initiative on Aging Subcommittee of the Consortium for a Healthier Miami-Dade.
Jason has previously sat on a 11th Judicial Circuit Grievance Committee and was honored with a proclamation (Jason Neufeld Day) from North Miami Beach Mayor Rabin in 2007 for his civic activism.

- Q. Do co-successor trustees have full control over where proceeds from a home sale are deposited/distributed?
- A: Hi there - No, a trustee's role and job is to follow the instructions within the trust. In most revocable trusts, the trust document itself will state who gets what after the grantor (creator of the trust) passes away. In short: see what the trust says! You should check with an elder law or estate planning attorney to review with you. I hope this helps!
- Q. My wife and I are both disabled I am on sddi she is on ssi we are considering divorce so she can draw a higher amount
- A: Your SSDI will not be impacted because it is based on your work history (regardless of income/assets). However your wife's SSI could negatively be impacted by being married because part of your income may be being "deemed" to her and therefore can result in her receiving a lower monthly SSI benefit. This is sometimes referred to as the "marriage penalty" and is unfortunate. In 2022, the maximum SSI monthly benefit is: $841/mo. In 2023 that will increase to $914/mo. If your wife has no other income sources and is making less than the maximum benefit, speak with an experienced SSA-focused attorney to discuss next steps and whether getting a divorce would be helpful. If you do get a divorce, remember that proper estate planning is important. For example, if you have a power of attorney, in Florida that POA becomes null upon divorce (unless the POA specifies otherwise).
- Q. if im married can I change my will so when I die my husband doesn't get our marriage assets in state of Florida
- A: Florida Statutes are very clear: the surviving spouse is entitled to 30% of the value of the deceased's spouse's estate (this is referred to as the "elective share", and I put a link to the statute at the bottom of this answer). The right to an elective share can be waived, but the spouse will need to sign a waiver knowingly and you'd be well-advised to have separate attorneys on this matter. You can, however, certainly speak with your own estate planning attorney and arrange your assets in a way (usually via revocable trust) so that your spouse only gets 30% should you pass first.
