Q. Commercial tenant in Florida faces rent and tax issues despite lease terms on escalation limits.
A: 25% increase is outrageous and may clearly cause you to default. It does not sound like the landlord is abiding by the terms of the Contract. However, to be sure, the best way is to send the Contract to a real estate lawyer. Once we review it, we can advise if in fact there is a clause that caps or limits the increases and what other terms pertain to the rent. Perhaps there is one clause that cancels this out, but not sure till its reviewed. If the landlord is in breach and the rent cant be increased, then you have the right to continue to pay the regular rate. Florida has just repealed sales tax on commercial rentals so in October your rent will further go down if that is being collected. Q. Unlicensed contractor issue with sinking RV pad, need legal advice.
A: You need to contact an attorney that is well versed in contract law and litigation. Sounds like a breach of contract issue but obtaining more facts will allow us to ascertain any additional counts depending on your damages.
Q. Tenant incarcerated, how long before property is considered abandoned?
A: Florida statutes states that if the tenant is absent from the property for half the time of the term, then it can be considered abandoned. So if the tenant pays from month to month and has been gone for 15 days, then it is considered abandoned. In this case however since you know the tenant is in jail, it may be an issue. As he cant be in two places at one time. If he has not paid while in Jail, I would do a three day notice, post it and then evict. It might prove easier.
