Q. The police said that I admitted to a meth pipe being mine that is a lie I was set up it is a felony in Georgia
A: Possession of a drug-related object (a pipe, for example) is a misdemeanor in Georgia. However, if there was meth residue in the pipe that was enough for them to test-you could also be charged with possession of methamphetamine, which is a felony.
Q. How much time do you have to sit in county jail for a misdemeanor probation violation for a second violation?
A: Potentially, on a second probation violation, a probationer could have the balance of whatever is left on the probated sentence revoked. Depending on how long is left on the sentence, that could be weeks or months. What is alleged to have occurred that violated probation is also a factor. It is not unusual for someone to be revoked (i.e. sentenced to jail) for 60 days or even longer on a second violation. I would expect your boyfriend to be on a probation violation calendar sometime in the next two weeks to 30 days.
Q. can you appeal a guilty plea ?
A: Yes. You must file a notice of appeal within 30 days after entry of the judgment of conviction and sentence.

You can also file a motion to withdraw a guilty plea. A motion to withdraw a plea of guilty must be filed before the end of the term of court in which the plea is entered. Your local clerk of court can tell you what the terms of court are for your local judicial circuit.

Finally, if you believe your guilty plea and/or sentence substantially denied you of your Constitutional rights, you can file what's known as a habeas corpus petition. Habeas corpus petitions must be filed within 180 days for traffic offense convictions, one year for misdemeanor convictions, and four years for felony convictions. ... Read More
