Biography

Atlanta Criminal Defense Attorney Glenn Stern learned how to practice law representing indigent clients for the Rockdale County Public Defender's Office - one of metro Atlanta's toughest places to be charged with a crime. In private practice, Glenn has continued to use that skill and training for decades, winning dismissals and reductions for his clients.

A graduate of the Stetson University College of Law (nationally renowned for their trial advocacy program), Glenn gained valuable insight into how the "other side" works, trying cases for the Hillsborough County Florida District Attorney's Office as a third-year student.

Q. How does rule nisi assist in bond reconsideration in Georgia?
A: A Rule NISI is just a form; the judge's office fills it out with the time and date for your motion, and then sends out a copy to both sides so they know when it's scheduled.

The factors that are considered when deciding on whether or not to grant bond are:

1. risk of fleeing;

2. danger to the community;

3. risk of committing a felony, and

4. risk of intimidating witnesses or obstructing justice.

When you are asking the court to reconsider bond, you must point to specific facts and circumstances that are different/have changed or that the court was previously not made aware of, and that those facts of circumstances change the calculation for the factors set out abov e. ... Read More
Q. How to dispute a summons for running a red light in Georgia?
A: Unless you have dash cam footage or there were traffic cameras that recorded the incident (and you can find them and get a copy of the video-if such cameras even exist), it will come down to your word versus the officer's word in court. Most of the time, that is not a formula for success in traffic court, and without more-"I believe the officer made an error" is not going to win the day.
Q. How to obtain a firearm permit in GA with past misdemeanor?
A: Anyone convicted of a domestic violence charge is banned from owning or possessing a firearm as per the Federal statute 18 U.S.C. § 922(g) (aka"the Lautenberg Amendment.")

As long as you have that conviction, you're not going to be able to have one. There may be a long-shot option or two to get the conviction off your record, but you would need an experienced attorney to look into the particular details of your case and the conviction.
