I started Make Your Trademark to assist individuals and small businesses to have access to brand protection and a trademark lawyer at an affordable price.

Prior to beginning Make Your Trademark I worked for a small Seattle law firm preparing and filing trademark and copyright applications as well as a sole proprietor assisting individuals and small businesses navigate trademark and copyright processes.

I am also COO of a the largest Electronic Voting Company in the United States, Democracy Live. As COO I not only run the business and operations but also am introduced to a variety of unique intellectual property issues.

Q. How can I claim the right to use a similar band name that was previously trademarked?
A: In order to claim rights to a prior trademark you must file a trademark application with the USPTO. If the mark is abandoned and it cannot be renewed or revived then you can file a trademark application for the same or similar mark in the same class of services. I recommend using a Trademark Attorney to review the prior mark and conduct a quick search if the mark is still available through the USPTO.
Q. I have a Book trademarked in Australia, does it also work worldwide and in the USA or do I have to have a US trademark?
A: In order to have protection in the US a Trademark must be filed in the United States with the USPTO. An Australia trademark does not protect you worldwide or outside the registered country.
Q. What do I need to move forward on a trademark.... I need an attourney
A: In order to move forward with a trademark you must file an in-use or intent-to-use application with the USPTO. It is recommend to do a quick search of the USPTO to check if your potential trademark is already in use. It is recommended but not required to work with a Trademark Attorney or Specialist to help guide you through the process of navigating the USPTO and to allow you to have the most optimal chance of a successful application and registration.
