- Q. Can I file for workers' compensation after missing the deadline due to incarceration?
- A: Dear injured worker,
I am sorry to hear about your predicament. As a general rule incarceration is not a toll to the one year statue limitations for filing of a Workers' Compensation claim in California. There are rare exceptions such as mental or physical incapacity. If you believe you have one of these rare exceptions I suggest you immediately consult with a California workers compensation attorney.

- Q. Can my employer mandate seeing PCP for workplace injury confirmation?
- A: Dear Injured Worker,
Access to medical care is fundamental in the California workers compensation system. Your employer generally cannot require you to see your Primary Care Physician (PCP) first for a work-related injury unless you pre-designated that doctor before the injury occurred. Otherwise, you typically must be treated by a provider in the employer’s Medical Provider Network (MPN). You may want to consult a workers’ compensation attorney to protect your rights.
