- Q. How long will Maryland take to decide if they want to come pick up my daughter from WV on Misdemeanor charges from 2018
- A: If you follow Mr. Oakley's advice and the prosecutor won't drop the charges altogether, maybe they will agree to recall the warrant (or decline extradition) and allow your daughter a certain amount of time to present herself voluntarily as she has retained an attorney. She will make out much better short and long term if she presents herself to the court.
- Q. Can a 4th degree burglary charge in Maryland be expunged?
- A: If you were found guilty of one of these charges you may request an expungement no less than fifteen (15) years after the guilty conviction or the satisfactory completion of the sentence, including probation, whichever is later:
assault in the second degree,
violation of an interim peace order,
failure to comply with a protective order,
felony theft,
possession with intent to distribute or dispense a controlled dangerous substance, or
burglary in the first, second or third degree.
