Court Koehler neglected timely action in my case. The fall out is extensive & very costly to me
Court Koehler and Koehler Law Offices PLLC, neglected timely action in my case and the fall out is extensive and very costly to me.
I had a DUI case against me, which I had hired and paid Court Koehler / his company for legal representation. I had
given him my trusts expecting him to act in a timely manner to all aspects of my case. I had a mandate to Request a Hearing with the DMV. There was a specific 10 day timeline for me OR my representative to file a hearing with the DMV. Koehler said that it was now in his hands and he would file for this hearing. And these hearings are quite important to anyone rightly or wrongly accused of a DUI. Court Failed to file for this Driver's License Division DMV hearing within the time frame, which was required by law.
After this first negligence had occurred, Court Koehler acknowledged this oversight (that he had "dropped the ball" so to speak) and proceeded to apologize, and re-assure me that he had time to submit a "Late Hearing Request" from the DMV, and that he would do so immediately.
I found out within 48 hours of my arraignment that Court Koehler HE FAILED to request the LATE HEARING as well! (he dropped the ball AGAIN!)
He then attempted to gloss over this second neglect and prepare me to meet him in court the following day, to further his representation of my case.
I WAS so distraught that I was being steamrolled by my independent non-court-appointed, hired legal representative.
I FIRED HIM immediately as I could not trust the man nor his claimed commitment to act on my behalf nor my best interests.
I requested and received a refund for what I had paid him. But I already knew that the damages and time and the loan I had acquired for his services were going to be greater than the exact amount I paid him. I even mentioned that if he wanted to refund me an indeterminant amount that he could do so. I received the exact amount that I had paid Court Koehler, Koehler's company, Koehler Law offices PLLC,
I did not have time to pay for another attorney. And I honestly had LOST FAITH in Lawyers and representation all together at this time.
I ended up fighting the case myself Pro se. And I "won" the case, but "with prejudice".
The charges were in February and the case was resolved in August of the same year.
I had to spend so much of my time and attention to learning how to file and argue my own case in lieu of my loss of faith in representation.
I KNEW FROM THE BEGINNING OF MY ARREST that I was NOT GUILTY of the charges as they had been filed against me. And felt exonerated by the end of 6-7 month ordeal.
Because Court Koehler esq had failed me and my DMV hearing, I had also lost my license and being a physically disabled person, had to go to great pains to take public transport to get to the court house and the copy locations and I suffered greatly during this time. As well as spending time away from my own work, in order to find and order my legal arguments, to win my case.
So I again I openly re-approached Koehler to see if he wanted to perhaps pay for damages incurred before I filed a civil case against him and his company. To which he did not respond.
And frankly I was exhausted and tired and did not want to file and fight another legal battle, against he who was originally supposed to help. And I purposely decided to reach my two year limit to file the case I could have taken up against his neglect. "Let by gone be by-gone".
I had mentioned in my filings in my case several times the error of hired attorney, essentially restating what I mentioned above here. Such as to show the miscarriage and issues with my relationship to the court and my case per se.
I did not find a proper place to file a complaint against Koehler online that he could not simply have removed, until oddly enough today. If this lawyers.justia.com does what it's terms state.
This being said. I appealed to the DMV to remove the mark against my record, to which they will not, stating statute without citing statute, and I then also last year attempted to utilize a temporary legal window to have this record expunged from me record last year, and was denied. This attempt also cost me money and time.
I now pay HUGE insurance costs to drive my work vehicle, DESPITE WINNING THE CASE ON MY OWN and apparently will continue to do so for the next 10 YEARS, because of the apparatus of the DMV's relationship to DUI Arrests, and my relationship to the DMV and Driver's License Division.
And I CANNOT HELP but to think that Koehler's oversight, neglect or pure malfeasance, has cost me much already and will continue to cost me great deals of money for 10 more years.
And somehow I think that this complaint should be made against this Lawyer and his company.
I'm not saying that Koehler normally does this, just that he screwed up twice, tried to placate me, and I am much worse off due to hiring/trusting the man.
