Candace Alynn Hill Duvernay is a trial lawyer, mediator, and part-time Judge. These various experiences allow keen insight into the different cases handled. - Q. Can an officer also be a prosecutor in issuing a search warrant?
- A: Yes, the officer is considered the prosecutor of the search warrant because he or she is the one presenting the alleged probable cause to the magistrate as they are requesting the issuance of the warrant.
- Q. Judge in criminal case is friends with opposing side, pictures available, recusal motion filed.
- A: Judges are to ensure fairness and stay away from the appearance of impropriety. If you are the defendant and you feel like the Judge's behavior has been unfairly prejudicial, you are right to raise the concern. However, most lawyers and judges know each other and often know each other very well. When you practice long enough, you make connections with people who are handling cases in your courtroom. If you cannot point to something the Judge did that unfairly prejudiced you, then the recusal motion may be denied.
- Q. Can police use evidence found during a medical response to get a search warrant in GA?
- A: If it was an emergency and they entered to administer aid and while they were there, they saw drugs and a weapon in plain sight, then they have a right to go back to retrieve a search warrant.
