XM Satellite Radio- Represented XM in rate court proceeding versus record industry to determine fees paid by XM for rights to use music. Achieved victory for XM after several week bench trial. PAI Partners Arbitration - Lead counsel for French private equity firm. Prevailed in arbitration, multi-million dollar breach of contract claim. Duquesne Light and Power v. Westinghouse Electric Corporation - part of trial team representing Westinghouse in several hundred million dollar product liability, fraud, RICO and breach of contract case involving sale of nuclear power plant equipment. Case resulted in complete defense verdict after three-month jury trial. Furnas Centrais Eletricas v. Westinghouse Electric Corporation - part of trial team representing Westinghouse in several hundred million dollar product liability, fraud, RICO and breach of contract international arbitration before International Chamber of Commerce. Case resulted in defense verdict after six-week arbitration. Vivendi v. EchoStar - obtained mandatory preliminary injunction as lead counsel for Vivendi in breach of contract action against EchoStar involving billion-dollar contract and satellite telecasting rights. Heilig-Meyers v. Prudential - lead counsel for Prudential in three-week trial arising from bankruptcy preference action. Achieved complete defense verdict in $70 million case. Gillette v. Schick - Co-lead counsel for Gillette in arbitration against leading competitor Natural Answers v. SmithKlineBeecham - lead counsel for GlaxoSmithKline in action alleging theft of trade secrets, trademark violations and false advertising.
