Anwar E. Hadeed was born and raised on the beautiful twin islands of Antigua and Barbuda in the Caribbean. The son of Syrian immigrants who moved to the islands in the 1980s, Anwar’s upbringing was shaped by the rich cultural traditions of the Caribbean and the Middle East. At 17, he moved to the United States to pursue higher education, driven by a passion for understanding human behavior and society.

Anwar graduated summa cum laude from Moravian University in Pennsylvania, earning double majors in Psychology and Sociology. As an undergraduate, he excelled in leadership roles, including President of the Psychology Club, and conducted groundbreaking research presented at national conferences. Following his graduation, Anwar achieved a lifelong dream by attending the Florida International University (FIU) College of Law, where he consistently earned a spot on the Dean’s List and actively participated in organizations such as the Caribbean Student Bar Association and International Law Students Association. During a study abroad program in Spain, he deepened his understanding of international legal systems.

While in law school, Anwar clerked at prestigious firms specializing in probate, guardianship, and estate planning, gaining invaluable experience. After passing the Florida Bar, he focused his career on these areas, helping hundreds of families navigate complex legal matters with compassion and clarity.

In 2024, Anwar established Hadeed Legal, a boutique law firm in Coral Gables, Florida. The firm offers affordable, flat-rate legal services in probate, guardianship, and estate planning. Known for his personalized approach, Anwar is committed to providing accessible and high-quality legal solutions while fostering strong client relationships.

Q. My mother wants to gift/sell a home for half the value. Is she able to gift this without any tax implications?
A: An Enhanced Life Estate Deed (Lady Bird Deed) or a Revocable Trust can help your mother transfer the home efficiently while avoiding probate and minimizing tax consequences.

Lady Bird Deed

This allows your mother to:

Retain full control of the home during her lifetime.

Avoid probate by automatically transferring the home to the named beneficiary upon her passing.

Preserve Medicaid eligibility and avoid estate recovery.

Allow the recipient to receive a step-up in basis, reducing potential capital gains tax.

Revocable Trust

Placing the home in a trust allows her to:

Maintain control as trustee while designating a successor.

Avoid probate and transfer the home smoothly to the beneficiary.

Still benefit from the step-up in basis.

Have more flexibility than a Lady Bird Deed for future changes.

If she wants a simple and cost-effective transfer, a Lady Bird Deed is a great option. If she wants more control and flexibility, a trust may be better.

Q. Bought house me as borrower mom coborrower what happens to property if one out live the other both no will
A: If you and your mother bought a house together and both names are on the mortgage, what happens to the property when one of you passes away depends on how the title (ownership) was set up. Since there is no will, the way the property is titled will determine the next steps:

Joint Tenancy with Right of Survivorship – If the deed states that you and your mother own the property as joint tenants with right of survivorship, then when one of you passes away, the surviving owner automatically becomes the sole owner of the property. Probate would not be needed for the property.

Tenants in Common – If the deed does not include survivorship rights and instead says you own the property as tenants in common, then each person’s share of the property passes according to state intestacy laws (since there is no will).

If your mother passes away first, her share would go to her legal heirs, which could include you and possibly other family members (depending on state law).

If you pass away first, your share would go to your heirs, which could include your children, spouse, or other next of kin.

In this case, probate would likely be required to transfer ownership.

Mortgage Responsibility – Regardless of how ownership is structured, the mortgage still needs to be paid. The surviving co-borrower would remain responsible for the loan.

Next Steps:

Check the deed to see if it specifies joint tenancy with right of survivorship or tenants in common.

Consider setting up a will or estate plan to ensure the property passes according to your wishes and avoids unnecessary legal complications.

Q. Should probate be opened in Texas or Florida? Brother passed away suddenly without a will.
A: I’m very sorry for your loss. Determining where to open probate depends on where your brother was legally domiciled at the time of his passing. Based on what you’ve shared, here are some key points to consider:

Primary Probate Jurisdiction: Since your brother had been living in Florida for over a year with the intent to stay permanently, Florida is likely the proper place to open probate. Generally, probate is handled in the state where the deceased was domiciled at the time of death.

Texas Considerations: If his only assets in Texas are a storage unit, this would typically not require probate. However, if there are assets tied to Texas (such as the proceeds from the sale of your late mother's home), an ancillary probate in Texas might be needed, but this depends on how those funds were handled.

Bank Accounts & Small Estate Affidavit: If your brother’s bank accounts do not have a Payable on Death (POD) beneficiary, they may require probate to access. Florida allows a Disposition Without Administration for very small estates with minimal assets, or a Summary Administration for estates valued under $75,000 (excluding exempt assets). If his total assets fall under this threshold, Summary Administration may be an option.

Next Steps: It would be helpful to determine if his bank accounts had a POD designation. If not, probate may be necessary to gain access. Since the uncle has his laptop, there may be financial records or emails that could provide clues about where his accounts are held.
