3 Questions Answered
- Q. What should I do after receiving a notice for a magistrate's hearing for assault and battery in MA?
- A: Hello! The next steps you should take is contacting a criminal defense lawyer who can help you with the magistrate hearing process. They would be able to get all of the documents including police reports submitted to the Court who issued the notice for the magistrate hearing. As well, a criminal defense lawyer would be able to strategize with you how to argue before the magistrate why under the current law the charges should not issue against you. The criminal defense lawyer also would be able to walk you through how the specific court handles magistrate hearings and what to expect when you go together to address the allegations.
- Q. My spouse filed for divorce in VT. I currently live in MA. Can a lawyer in MA represent me in VT for a divorce?
- A: Hello,
Unfortunately a MA attorney cannot represent you in a divorce in VT unless they are barred and licensed to also practice in VT.
There may be attorneys barred in both states due to their close proximity, but a MA attorney may not know the difference in the laws between MA and VT to even give you useful advice.
- Q. Im 16 and got my first charge for throwing milk at someone. I got charged with assault and conspiracy. will i go to juvi
- A: Hello,
The answer depends on the specific facts of your case and how serious the government or prosecution views the incident involved. Based on the information you have given, if you have no prior criminal record or involvement you will most likely not end up at a juvenile facility or in custody. You should contact an experienced attorney to help protect your rights especially in Juvenile Court where different standards can apply.
