Q. My husband and I have been separated since 2017. I’m terrified of him but I want to finally go through with the divorce
A: You should contact an attorney to discuss specific details, there is not much here to go on. If you want a divorce you'll need to go through the divorce process of filing in the probate and family court. If you fear for your safety and your child's safety, for any reason, you should consider additionally have restraining orders and making sure temporary orders are put in place regarding custody to protect your child and yourself. If the assistance you were looking for is financial, that can be determined in a temporary order as well.
Q. What can I do to recover damages? Anything?
A: As counsel has already stated if she's making defamatory statements about your business that is an issue outside your divorce. However, I do think there are issues you could address in your divorce on other matters. First, would be a potential modification if you are unable to make payments due to a substantial change in circumstances. Additionally, withholding a child from seeing their parent due to monetary issues is not allowed and a contempt could be filed against her. You should contact an attorney to give more specifics and get a better idea of what would be the best route for you.
Q. I have joint custody of my son and his father and step mom are keeping him from me.
A: If you have an order with parenting time that is in place, your ex is violating that order and you should contact an attorney to potentially file a contempt and request an emergency hearing. Parenting time orders are still in place regardless of the current pandemic, unless there is an order stating otherwise.
