Q. How long does is take to file a Chapter 7 after all documents have been turned in?
A: Once you submit the requested paperwork to your attorney (presumably including your credit counseling certificate), he or she will prepare your bankruptcy petition. Your attorney will then review the petition with you to confirm that the petition is complete and correct. If the petition is complete and correct, you will sign off on it and your attorney will file your case. Unless there is a reason to put your filing on hold, your attorney should be able to file your case within a day or so of collecting your signature.

Q. My husband moved to Florida we are not legally separated so could I file for divorce and bankruptcy at the same time?
A: You can file your bankruptcy case and your divorce case on the same day. However, from a practical perspective, it may make more sense to get your bankruptcy behind you before filing for divorce. This is because, by having the debt discharged before the divorce, you reduce the number of issues that need to be litigated or negotiated during your divorce case. You could save both time and money by resolving the debt issue before the divorce.

If you and your husband are on speaking terms, you may want to talk to him about filing a joint bankruptcy petition prior to the divorce.

This answer assumes you are filing a chapter 7 bankruptcy, which can be over in a matter of months. A chapter 13 bankruptcy involves a 3-to-5 year commitment.

A: The answer depends on multiple factors that are not clear from your question (e.g., the date you filed your bankruptcy case; the dates you took out each of your auto loans; what you elected to do with the second vehicle).

Unless you reaffirm a debt, your chapter 7 discharge will include all your eligible pre-petition debts (i.e., the debts you incurred before filing the case). If both of your auto loans were in place before you filed your bankruptcy and you elected to surrender one of the vehicles and (presumably) retain and pay for the other vehicle, then both of the auto loans would have been discharged under your chapter 7 bankruptcy.
