- A: In Maryland you can get divorce without something having happened that was either spouse's fault. If you relied on adultery as the reason for getting the divorce then you would have to prove adultery and this can be difficult. However, there are other "reasons," that attorneys and the law call "grounds" for divorce. You can also get a no-fault divorce, which is the easiest way. A no-fault divorce only requires that you be separated for one year before filing. The separation period is not usually in dispute between spouses, but you would go to trial on the other issues that need to be resolved. - A: I am sorry to hear that you are going through this difficult situation in your life. It is very important that you find an attorney with whom you can go into detail about this question given the different factors involved. It would not be wise to give a simple answer to such a very complicated and serious matter. Again, I encourage to speak to an attorney one-on-one.
- Q. My wife and I have filed for divorce. She purchased a house with my money in Maryland. Am I entitled to this property?
- A: If the house was purchased during the marriage it is likely that you both are entitled to half of the house because it is marital property. If it is marital property, either of you may propose to buy the other's interest in the house or you may put the house on the market and split the proceeds.
