Mr. Albert Loch Saslow

Loch Saslow is a 2009 graduate of Elon University School of Law’s inaugural class. Loch joined Hill, Evans, Jordan & Beatty following admission that year. Loch is a trial lawyer. He focuses his practice primarily in the areas of family law, bankruptcy, civil disputes, including business matters, and contractual issues, as well as Wills, Estates & Trusts.

A native of Greensboro, North Carolina, Loch holds a B.A. in History from Furman University in 2006 where he served as Community Service Chair of Sigma Nu Fraternity, played Club Lacrosse, and coached lacrosse at Riverside High School in Greenville, South Carolina. At Elon University School of Law, he was a member of the Business Law Society.

Loch is a member of the North Carolina State Bar, the American Bar Association, the North Carolina Bar Association, the Greensboro Bar Association, and the18th Judicial District Bar.

Q. My husband started a business 5 months before we separated.

A: Seems like the answer could depend on when the business entity (if there is one) was actually formed. If it wasn't formed (created) with the Secretary of State until after you separated, then there is an argument that the business wasn't marital. However, if that is the case, then you make the counter argument that the specific items of property, not the business itself, are marital property and subject to division.

Q. What should get added to a prenup if you bring a child from a previous marriage?

A: Unfortunately, you likely aren't going to get a clear answer on this type of forum. I would highly suggest that you DON'T try and handle your pre-nup on your own, and instead at least consult with a local family law attorney. I will say that the pre-nup might not have much that is directly related to this child, but you would want to make sure that any separate property of yours (and/or the childs) is specifically addressed. In general, pre-nups are going to have very little to do with a child from a previous marriage.

Q. Can I apply for child support from spouse after getting separated for 2 years, without getting a divorce?

A: Sure. There is no requirement that both actions are handled together. However, I do question why you haven't been divorced yet. Many family law attorneys offer a "flat-fee" divorce package that isn't too expensive. Alternatively, you can attempt to file it yourself.
