Mr. Bronson, Esq. is a zealous advocate for Criminal Defendants. Q. Can the police receive an anonymous tip than bring a dog to smell around a condo without a warrant, To get a warrant?

A: I agree with both previous answers provided. Additionally, The United States Supreme Court has previously held that a K-9 performing a search on someone's porch entrance to the home without a warrant is considered a search in violation of the 4th Amendment. As mentioned previously, a common/ public area around the home in a larger complex could be considered legal depending on specific facts.

Q. What happens filing a protected order with the commissioner?

A: I agree with Mr. Scherr, each proceeding has a slightly higher burden of proof to grant the protective order. At the temporary protective order hearing a Judge must find "reasonable grounds" supporting the person eligible for relief has been abused. At the final protective order proceeding a Judge must find by a preponderance of the evidence that the person eligible for relief has been abused.

Q. Hi so my significant other has a ongoing theft criminal case and ended up filing a criminal order at me

A: If you were charged with theft in relation to a case your significant other has been charged/ involved in, it is possible The State's Attorney's office believes you were involved in the criminal act as well. You should speak with an Attorney about the case, if you cannot afford Private Counsel and have been charged you can apply for a Public Defender at the Commissioner's Office. If investigators attempt to contact you and question you, it is very important you speak with Counsel beforehand. Trying to talk your way out of an investigation without a Lawyer will not benefit you in any way.
