Currently, Mark is part of the team orchestrating the strategy and response of The TJX Companies, Inc. in connection with a significant unauthorized computer network intrusion that has received considerable attention from the press. Mark is one of the lead lawyers representing TJX in multi-district consumer class action litigation in the United States and Canada and is also involved in a host of government inquiries and other related litigations. Mark is also involved in defending the current wave of class action litigation under the Fair and Accurate Credit Transactions Act ("FACTA") relating to information printed on payment card receipts and is working on litigations for two different public companies in Indiana and Kansas. Previously, Mark was one of the lead lawyers defending Gillette against a multi-district consumer class action based on advertising claims relating to its market-leading M3Power razor. In the complex litigation area, Mark has extensive experience in securities litigation, regulatory enforcement matters, bankruptcy matters, franchise disputes, and commercial litigation generally. He has handled such matters as representing a major brokerage firm in a series of disputes with the counterparty market makers stemming from a client's insider trading, assisting a large equipment financing company in seizing assets and unraveling conflicting lien claims resulting from a multimillion dollar load fraud, and defending an investment manager against qui tam allegations relating to its fee agreements with a public body. His experience also includes representing mutual fund clients as plaintiffs in fraud matters and litigating dealership disputes and related injunction proceedings on behalf of a major automobile manufacturer.
