- Prior to joining Ropes Gray, Mark was a partner of a large New York-based law firm. Mark regularly represents secured and unsecured creditors, official and unofficial committees, debtor in possession lenders, commercial landlords, and holders of public debt securities in complex cases arising under chapter 11 of the Bankruptcy Code and in out-of-court workouts and pre-packaged and pre-negotiated bankruptcy cases. He also has experience representing defendants in preference and fraudulent conveyance litigation and counseling purchasers of distressed assets and purchasers and sellers of distressed debt and bankruptcy claims. Other representative matters include: Ad Hoc Committee of second lien noteholders in In re Calpine Corp. DIP and exit lenders in In re Port Townsend, Inc. The Official Committee of Unsecured Creditors of Atlas Air, Inc., the Official Committee of Unsecured Creditors of Verestar, Inc. and the Official Committee of Unsecured Creditors of Gividi, Inc. Special counsel to the Official Committee of Unsecured Creditors of WorldCom, Inc., the Official Committee of Unsecured Creditors of Allegiance Telecom, Inc. and the Official Committee of Unsecured Creditors of Polaroid Corporation. Ad hoc committee of bondholders in connection with rights offering and 363 acquisition of substantially all assets of Tower Automotive, Inc. Various indenture trustees as a member of the official committee of unsecured creditors in numerous pending chapter 11 cases in the United States and in international insolvency proceedings, including a majority of the largest pending chapter 11 cases.
