- Ken'slitigation experience encompasses cases involving windstorm and flood catastrophies, terrorist attack and alleged 9/11 business effects; Year 2000 litigation expense, asbestos in buildings, product recall, environmental clean-up, railroad liabilities, chemical exposures, computer warranties, and aviation and real estate matters. During the lasttwenty-five years Ken has defended financial institutions and manufacturers in cases throughout the country. He frequently represents major property and casualty insurers located in the London Market, continentalEurope, Bermuda, and the U.S. He has many times served as national coordinating counsel for leading insurers on property, casualty and professional indemnity problems. Examples of major engagements include: Natural catastrophe - Lead first-party counsel for London, Bermuda and U.S. insurers in connection with 2005 named storms/numbered catastrophies. September 11, 2001 - Lead first-party counsel for London and Bermuda insurers in responding to claims and litigation arising out of terrorist attack, including the successful defense of London insurers in the World Trade Center litigation. Asbestos in Buildings - Lead counsel in the successful defense ofa $1 billion first-party property claim by the Port Authority of New York and New Jersey. Chemical Solvents - Lead counsel in the successful jury trial defense of third-party FELA coverage claims by major American railroads. Professional Indemnity - Coordinating counsel for insurers in connection with certain lawyer professional indemnity claims. Product Recall - Representing first-party insurers in claims for the withdrawal/recall of products form the market. Environmental Claims - Serving as national coordinating counsel and defending litigations against first-party property policies, including cases in New York, New Jersey, California, and Washington state. Y2K Issues - Serving as national coordinating counsel for the London Market and acting in matter involving first-party property placements and date-recognition in computer systems. Repetitive Strain - Coordinating and defending third-party cases in Florida and Ohio alleging rights to coverage for occupational diseases. Noise-Induced Hearing Loss - Coordinating and defending cases in Virginia and Maryland involving claims against eastern and southern railroad systems. Asbestos Bodily Injury - Coordinating and defending cases in Washington, D.C., and Virginia involving claims against national railroad systems. Pharmaceutical Products - Coordinating and defending cases in Washington, D.C., New York, and Connecticut that assert time-delayed liabilities against manufacturers. Business Torts - Advising about coverage and defending cases in Texas and elsewhere that present claims for coverage as business torts. Property Damage - Defending claims and cases in Massachusetts and elsewhere involving alleged physical damage, business interruption, and extra expense. Bodily/Personal Injury - Defending cases in Massachusetts that assert bodily or personal injury caused by insured entities.
