- John has significant experience representing public companies and individual officers and directors in complex securities fraud cases defending against shareholder class actions and derivative litigation in both federal and state courts. He has recently represented clients in cases involving stock options backdating and tracking stocks securities litigation. John has also represented individual clients in enforcement actions before the Securities and Exchange Commission, on such issues as market timing and failure to supervise liability. He has advised public and private companies, hedge funds and private equity funds in corporate transactions, including mergers and acquisitions, concerning current and potential shareholder and transaction-related litigation. John has also advised committees of the board of directors of public companies in connection with internal corporate investigations. In addition to his securities practice, John has defended corporate clients in a broad range of litigation matters, including antitrust, environmental, patent infringement and products liability litigation. He has recently represented clients in the pharmaceutical industry concerning drug pricing fraud litigation brought by various state attorney generals. John has successfully second-chaired a complex products liability jury trial on behalf of a large automobile manufacturer concerning its shield and insulation design. He has also represented clients in commercial arbitration disputes, and successfully defended a wrongful termination action brought by a former senior corporate officer. John has written several briefs before federal and state appellate courts, and argued before the United States Court of Appeals for the Seventh Circuit and the Massachusetts Appeals Court. He represented a client on death row in Alabama, and obtained a reversal of his client’s death sentence in the state criminal appellate court on ineffective assistance of counsel grounds.
