Elle Byram earned her law degree at the University of California Davis, School of Law. She also earned her Bachelors in Psychology at the University of Colorado at Boulder as well as a Masters in clinical psychology at Pacific Graduate School of Psychology in Palo Alto, CA. Elle has a broad background, enabling her to serve the legal needs of a variety of clients. Elle worked at large and small law firms practicing in both litigation and corporate work. She also has worked as in house counsel for a software company honing her legal business skills. Desiring to start her own practice, Elle stepped out of the corporate world in 2013 and began her own solo firm focused on family law, estate planning and probate administration, business law and some civil litigation.

- A: Oral contracts can be valid so long as they satisfy the statute of frauds. I believe yours would satisfy the statute of fraud. The texts messages may actually give you a written contract depending on what is stated in them and whether the essential terms are there - I.e. The amount you loaned him and that it was a loan for the most part. Regardless, if all you have are vague texts and oral agreements it may be difficult to win, but you can always file a small claims case against him (or try to get it into the divorce as an issue to be divided upon your final dissolution) and see what the court does.
