24 Questions Answered
Q. 3 disc herniated ,job offered $30,000 for a 12% permanent and stationary disability in California .Is this lowball?
A: Without a review of the medical records including the MRI report and quite possibly the Nerve conduction study if one was done to show possible nerve problems radiating down one or both legs it would be difficult to say if the rating was totally fair.
Q. I have suffered a work related injury last 2/9/18 and went through all the the treatments and ended up having surgery.
A: If Your permanent disability is only worth 2% then the amount of money they’re offering you is correct. But if your doctor underestimated your disability your claim would be worth a lot more money you should have an attorney Review your case and the medical report the insurance company is basing 2% on.
Q. I have a work related injury from 2016 I had surgery and also suffer from arthritis this has not only taken a toll on
A: This is a qualified NO... if it is found to be a compensable consequence of the work injury, and your doctors prescribe psychological treatment and or medications work comp will pay for it generally but they will not allocate further disability to the psyche condition. this has been the law since 2013.
