I started my firm so I could provide detailed service and attention to each of my clients.

I'm an active member of Colorado’s legal community. I'm Chair of the Colorado Bar Association (CBA) Solo Small Firm. I'm also a member of the: Colorado Bar Association Litigation Section, Denver Bar Association, and Colorado Trial Lawyers Association. I also teach attorneys about Witness Competency for the Colorado Bar Association.

Q. My wife was in a car accident in Jan 2020 where the other driver ran a red light and was cited. She hasn't worked since,
A: MMI is more of a worker's comp term rather than personal injury. As stated above, it is not required. However, your wife's settlement with the third party insurance company is a lump sum payment. So typically it's best to wait until treatment is finished so that the attorney and her know the full extent of her damages and can get the most for her claim. If the policy limits are lower, you may be able to move forward based on what treatment has already been received. Your attorney should know what the policy limits are due to a new law that took effect in January.
Q. I am reading CO Rev Statute 10-4-609 (UM/UIM) as my Insurance Co cannot "offset" what the at vault party's Insurance Co.
A: I understand why you might think that but unfortunately that is not the case. 1(c) states that UM/UIM "shall cover the difference, if any, between the amount of the limits of any legal liability coverage and the amount of the damages sustained." The statute recognizes that one may be fully compensated by the third party liability insurance. However, if there is a difference, then you can proceed with your UM/UIM insurance. The amount you can receive from UM/UIM cannot be offset by other coverage like medical payments.
