Biography

Andrew Marcellino is a seasoned lawyer who has represented many clients throughout Santa Clara County in the trial and mediation process. He fights for his clients in the courtroom, but emphasizes negotiation and mediation as alternatives whenever possible. He does this to save his clients time, money and emotional stress, and to help them retain control over their legal results.

We assist family law clients in matters of domestic violence, divorce, custody and visitation, child support, restraining orders, property division, modifications of court orders, paternity matters, and other issues related to family law. We also provide experienced representation in criminal defense matters. In all cases, we listen to our clients, help them identify their goals, and then do everything possible to reach those goals. We believe strongly that clients should be in control of their legal matters. Our job is to inform, advise and counsel our clients so they can make good decisions, and then to execute those decisions efficiently and effectively.

Q. My son's father signed all his rights over to me I have full custody of my son now can the father ask for 50/50 still
A: There is a difference between signing "all of his rights over to you" and simply having sole custody. If Father legally terminated his parental rights, then he cannot seek custody. If Father did not terminate his parental rights, then he can seek a modification of custody depending on the circumstances particular to your case, whether or not there has been a substantial change in circumstance (if applicable), what is in the best interests of the child, etc... You should consult with a local attorney to discuss in more detail.
Q. My boyfriend is currently paying back child support as ordered and complying with the full monthly amount.
A: So long as your boyfriend is paying child support arrears according to a current existing order, DCSS should not intercept money from his bank account. This is not to say that such a thing never happens, though. It would be best for him to speak with DCSS or have an attorney speak with DCSS to make sure THEY BELIEVE his account is in good standing.
