- Q. In VA, 12 mnths of separation is req'd w/ minors before divorce. Do I need notarized separation agreement to prove date?
- A: You do not need a Separation Agreement document to establish your date of separation. That date will be stated in such an Agreemenet though. Your spouse cannot refuse to sign a Separation Agreement to forever delay your separation period for example. Your date of separation is largely up to you all--unless somebody wants to go to court and fight over it. This happens, but it is rare. When someone communicates that they want to separate--heading toward a divorce, and somebody moves (in house or out to an apartment), that is typically your date of separation. As long as there's no collusion or attempt to sidestep the law for some reason, you're going to be OK with that date. People ... Read More
- Q. Am I entitled to 50% of our savings in a divorce?
- A: A joint savings account is presumably a marital asset and as such is divisible in a divorce proceeding. It does not matter who "made the money." That would apply only to money made during the marriage, probably not that which was in the account at time of marriage. The other questions are best handled by a consultation with a lawyer who can get into the facts of the case and help advise you more specifically. Our best to you.
- Q. My ex and I agree to modify the morality clause to set a timeline of 6 months in a relationship before overnight stays.
- A: Unfortunately, probably not. There is a procedure that one must follow involving a Motion to Amend, but sometimes before that, we lawyers might have to file something to get the matter "before the court" A court cannot rule on something that's not rightfully in its view--even a Consent Order. Maybe your case is open, and maybe it's not, but there must be an open case for a court to take something up. It must have proper jurisdiction somehow. There are many factors that are important in this discussion. My advice is to involve a lawyer to get this done well and right. There is not a lot of work involved in what you are suggesting, so I do not think the cost will be overwhelming. ... Read More
