Legal Answers
9 Questions Answered
- Q. Drunk driver totaled my car tonight, how do I pay for new car? Can I sue? Will his insurance pay me?
- A: Sorry to hear about your accident. The car that started the chain reaction accident is at fault for all cars damaged including your property damage and personal injuries. However, if your car is declared a total loss and your remaining car loan is greater than the present market value of your car, you will be responsible for the (excess loan over your car's value) unless you have gap insurance for your car. For further information, contact my office at (240)676-4827. Thank you.
- Q. Is there a way/anything that I can say that will help negotiate lawyer fees in personal injury case?
- A: Presuming you signed a retainer agreement granting your attorney a fee equivalent to one third of the gross settlement amount recovered on your behalf, you are generally bound by the contract you signed to retain your lawyer.
Notwithstanding that you are not satisfied with the amount of work you attorney performed for your case, alternatively, you may request a fee reduction in consideration of your participation. Your attorney does not have to accept your request but on your approach and communication thereof, your attorney may give you a discount on the legal fee.
- Q. I was hit in a car accident. Lawyer says I can only get $30K bcuz that was other driver’s policy. Is this true?
- A: Check with the policy of your auto insurance of the policy of the insurance of the car you were driving in for the underinsured policy limit - it only kicks in for amounts in excess of 30K (for instance if your underinsured limit is 100K, you are able to collect a max of 70k from your policy under Maryland law - subject to ensuring that you follow statutorily required notification steps).
Also, sue the other driver and obtain a judgment. You never know what the defendant's profession is which may put the defendant in a position to have to find a way to satisfy the judgement. In any event, good luck.
