- Q. Can my employer lay me off if I've been hurt on the job and file a claim
- A: Yes, but frankly it's a bad and risky decision by HR to fire someone who gets hurt at work, unless they have a good reason beyond the injury itself. If the Employer terminated you due to your work injuries, then their insurance company would owe you "TTD" benefits - which is temporary total disability benefits under workers' compensation - so long as the treating doctor has you on work restrictions related to the work accident. TTD is a weekly wage replacement check, which is 2/3 of your pre-injury average weekly wage. Some states have "anti-retaliation" laws, which prevent employers from taking action against employees who exercise their workers' compensation rights, but unfortunately Georgia is not one of those states. It should be, in my opinion, but it's not. Georgia companies are, however, subject to various Federal laws which may or may not apply to your employer. The Family Medical Leave Act, for example, provides employees with a serious health condition with several months of job protected, but unpaid leave. Long story short, you have a complicated situation, and you should consult and attorney. I wish you best of luck. - A: That's awful! My bigger concern would be whether your airbag went off. If not, you may have a claim against the airbag/auto company. If you had a bad wreck, and your airbag failed to deploy, causing you injury, you should call a lawyer to discuss that further.
- Q. would it be suspicious if I was notified 40 minutes before time of death on the death certificate
- A: Certainly some of what you are describing could be suspicious, or it could be coincidence. On these limited facts, it's difficult to know for sure. If you have strong reason to believe that someone was negligently killed (not intentionally), consider consulting both a personal injury attorney and the police. I will warn you, however, that insurance does not typically cover intentional crimes (i.e. murder and certain types of homicide). Likewise, most people do not have sufficient assets of their own, such that an attorney would be interested in taking a personal injury lawsuit against an individual. So, you may have serious difficulty finding a personal injury attorney who is interested in investigating an alleged murder. Accidental death is actually much easier to pursue. Hence, the police may be your best bet if you believe foul play is involved. Good luck!
