Todd B. Kotler
Wayne County Public Defender Program
Since 1999 I have labored to establish divorce settlements that are firm but fair and parenting-time schedules that work. Relocating and long-distance parenting plans. I resolve high-conflict situations, protective orders, and deal with parental alienation. I also have litigated a number of high value cases in both Summit and Stark Counties.
My firm also has handled a great number of high value transactions involving mineral rights, land leases and easements with energy companies. We have done joint ventures, partnerships, S corporations, LLCs, commercial and industrial developments, condominium developments or conversions and office building sales and purchases. Likewise, I have drafted construction contracts, lease negotiation and preparations, loan workouts and foreclosures as well as sale and purchase contracts.
Notably, I am among a handful of Ohio Attorneys who practice special education law. My focus in this area is on the parents of special needs children. I aid them in ensuring that these children receive the free and appropriate public education (FAPE) that each child is guaranteed under state and federal law.

- Q. Can I retrieve belongings taken by my grandmother while living in her Ohio home?
- A: You have three choices. You could file a criminal complaint for theft. You could file a small claims complaint for conversion which is the civil tort that's similar to theft, where you're asking for a return of an item or its monetary equivalent. Lastly, you could continue to do nothing and move out then ask for the items back. The legal action that you take may ultimately provide you back with the things that you have lost they will also undoubtedly create a great deal of tension and resentment in your family.
- Q. Can an unfit mother reclaim custody?
- A: Under these facts it is possible but highly improbable. There is much that you did not include that I would want to know. When you said "labeled" unfit. By who? Was that part of a court order? If so, mother would need to file a motion to modify the current custody order. In order to succeed, she would need to prove that there was a substantial change for the child rather than her. That is not indicated in this instance however.
- Q. Legal remedies to ensure father's burial wishes are honored despite claims of marriage.
- A: I would find out where they were allegedly married and see if there is a marriage licence registered there (with the proof of solemnization of the wedding). If there is no wedding then she would at the very least need POA or be listed as a Health Care Declaration proxy. Your question did not indicate whether your father is still competent. If so, new forms may be filled out better articulating his wishes.
